Frequently Asked Questions

Q1. I am a psychiatrist how do I register for CPD.

A1. You do not need to be a member of the Royal College of Psychiatrists to be registered with them for CPD. Registration for CPD is a South West criteria requirement for Section 12 approval. You need to contact the Royal College of Psychiatrist on 020 7235 2351 ext 108, they will advise you how to proceed with your registration. Once registered you need to inform the Section 12 Lead of your registration number.

Q.2 As an RMO do I need to be Section 12 approved to renew my patients section 3

A.2 No you do not need to be approved to renew a section 3 if you are the RMO.

Q.3. Can an RMO section a patient immediately after they are discharged by managers/MHRT if the RMO disagrees with the decision?

A.3 The patient can be assessed for section but can only be detained if there has been a change in circumstances or if there is information that was not available for consideration by the MHRT.

Q.4 Who checks the recommendation for the Trust and why?

A.4 The mental health act manager so that rectifiable errors can be corrected within 14 day and a consultant will also scrutinise the 'reasons'.

Q.5 Who has the responsibility to arrange (a) conveyance and (b) find the bed.

A.5(a) the Social worker. (b)the section 12 doctor

Q.6 How do I get paid?

A.6 Ask a social worker for a claim form and record their name (to put on the form).

Q.7 Can I interview a patient, who refuses to come out, through a locked door?

A.7 No consider a section 135.

Q.8 Do you all course venue have accomodation at them?

A.8 Yes all venue we choose for our training events have good quality accommodation attached to them. You need to ring the venue to book directly to book any accommodation.

Q.9 Is my Section 12(2) approval only valid in the area where the approval was granted.

A.9 No once you are approved your approval is valid for use anywhere throughout England and Wales it is not valid in Scotland. However you must inform the Section 12 administrator in the region you are working to ensure they maintain your registration status and you are included on their register.

Q10. Is there any guidance to preparing a report for the Mental Health Review Tribunal available.

(a) any institution for the reception and treatment of persons suffering from illness,

(b) any maternity home, and

(c) any institution for the reception and treatment of persons during convalescence or persons requiring medical rehabilitation,

and includes clinic, dispensaries and out-patient departments maintained in connection with any such home or institution, and "hospital accommodation" shall be construed accordingly;
